Terms and Conditions
1. Acceptance of Terms
By booking any tour, travel package, transportation service, accommodation, or other travel-related service with Inca Roca Travel (“the Company”), the client acknowledges that they have read, understood, and accepted these Terms and Conditions.
2. Booking and Reservation
A reservation is considered confirmed only after:
- The required deposit or full payment has been received.
- The Company has issued a written confirmation via email or other official communication channels.
- The client has provided all required personal information and travel documents.
The Company reserves the right to refuse any booking at its discretion.
3. Payments
- A deposit may be required to secure a reservation.
- The remaining balance must be paid by the deadline specified in the booking confirmation.
- Reservations made close to the departure date may require full payment at the time of booking.
- All bank transfer fees, credit card charges, and international transaction fees are the responsibility of the client unless otherwise stated.
Accepted payment methods may include:
- Credit/Debit Cards
- Bank Transfers
- PayPal
- Other approved payment methods
4. Prices
All prices are quoted in U.S. Dollars (USD) unless otherwise specified.
The Company reserves the right to modify prices before confirmation due to:
- Government taxes
- Fuel surcharges
- Transportation cost increases
- Exchange rate fluctuations
- Changes imposed by service providers
Once confirmed and fully paid, prices will generally remain unchanged except when required by law or force majeure circumstances.
5. Client Responsibilities
Clients are responsible for:
- Providing accurate personal information.
- Ensuring their passport is valid for travel.
- Obtaining any required visas or permits.
- Carrying valid identification during the trip.
- Following local laws and regulations.
- Following the instructions of guides and tour leaders.
The Company is not responsible for losses resulting from incomplete or incorrect information provided by the client.
6. Travel Documents
Clients must provide all requested documentation before travel, including but not limited to:
- Passport copy
- National identification documents
- Student cards (if applicable)
- Medical information relevant to the trip
Failure to provide required documents may result in cancellation without refund.
7. Changes Requested by the Client
Any request to modify:
- Travel dates
- Passenger names
- Itineraries
- Hotel selections
- Transportation services
must be submitted in writing.
Changes are subject to availability and may incur additional costs imposed by suppliers, transportation companies, hotels, or government authorities.
8. Cancellation Policy
By the Client
All cancellation requests must be submitted in writing.
Refund eligibility depends on:
- The date of cancellation
- Supplier policies
- Government regulations
- Non-refundable permits and entrance tickets
Certain services, including Machu Picchu entrance tickets, Inca Trail permits, train tickets, and other government-issued permits, may be non-refundable and non-transferable.
Administrative fees may apply.
9. Cancellation by the Company
The Company reserves the right to cancel or modify any service due to:
- Safety concerns
- Weather conditions
- Operational issues
- Government restrictions
- Insufficient participation
- Force majeure events
In such cases, the Company will offer reasonable alternatives or applicable refunds where possible.
10. Force Majeure
The Company shall not be liable for delays, cancellations, losses, or additional expenses caused by circumstances beyond its control, including but not limited to:
- Natural disasters
- Earthquakes
- Floods
- Landslides
- Strikes
- Political unrest
- Terrorism
- Epidemics or pandemics
- Government restrictions
- Transportation disruptions
The Company may modify itineraries without liability when necessary for the safety and well-being of clients.
11. Health and Fitness
Clients are responsible for assessing their physical ability to participate in tours.
Certain tours involve:
- High altitude
- Hiking
- Trekking
- Adventure activities
Clients must disclose any relevant medical conditions before departure.
The Company reserves the right to deny participation if a client’s condition may endanger themselves or others.
12. Travel Insurance
Inca Roca Travel strongly recommends that all clients purchase comprehensive travel insurance covering:
- Medical emergencies
- Accidents
- Trip cancellation
- Trip interruption
- Lost luggage
- Evacuation expenses
The Company is not responsible for uninsured losses.
13. Liability
The Company acts as an intermediary between clients and third-party service providers including:
- Airlines
- Hotels
- Train operators
- Transportation companies
- Local operators
The Company shall not be liable for acts, omissions, negligence, delays, injuries, damages, or losses caused by third-party providers.
Participation in adventure activities is at the client’s own risk.
14. Complaints and Claims
Any complaint must be reported immediately during the trip to allow an opportunity for resolution.
Formal claims must be submitted in writing within 15 days after completion of the service.
Claims submitted after this period may not be considered.
15. Privacy Policy
Personal information collected by the Company is used exclusively for:
- Reservation processing
- Operational requirements
- Communication with service providers
- Compliance with legal obligations
The Company will not sell or distribute personal information to unauthorized third parties.
16. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Peru.
Any dispute arising from these Terms and Conditions shall be subject to the jurisdiction of the competent courts of Peru.
